V. Payment of Patent Annuity

Although a grace period of six months is provided for payment of fees for granted patents, some unexpected and uncontrollable things may arise and a patent may be expired as a result of non-payment of required fees.

The new Patent Act makes it clear that the patentee may have additional fourteen (14) days to pay the fees to restore the patent after expiration of the grace period of six months provided in the Paris Convention Article 5 bis.
This additional fourteen days are applicable when the patentee shows the events were outside of this control. (Art 81 bis)
